These Terms of Service ("Terms") govern your use of SongPrompterAI ("the Service"), operated by Jamie Boyd trading as SongPrompterAI ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
SongPrompterAI is an AI-powered lyric generation platform. Given a genre, topic, and text brief, the Service generates original song lyrics, a music style prompt compatible with AI music platforms, and title suggestions.
You must be at least 18 years old to use the Service. By registering, you confirm that you meet this requirement.
To use the Service, you must create an account by providing a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
The Service is available on a paid subscription basis. Current plans and pricing are displayed at the time of checkout.
Payments are processed by Polar (polar.sh), which acts as our Merchant of Record. Polar handles all payment processing, billing, and VAT/sales tax compliance. By subscribing, you also agree to Polar's terms of service.
Subscriptions renew automatically unless cancelled before the renewal date. You may cancel your subscription at any time through the Polar billing portal. Cancellation takes effect at the end of your current billing period.
We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact us at [email protected].
If you exceed your monthly song generation limit, you may purchase additional credits. Overage credits do not expire and carry over between billing periods.
You own the lyrics generated by the Service using your account. SongPrompterAI does not claim any ownership, copyright, or licence rights over the output produced for you.
However, you should be aware of the following:
The Service itself, including but not limited to the software, algorithms, genre packs, user interface, and documentation, is our proprietary technology. These Terms do not grant you any rights to our intellectual property except the right to use the Service as described herein.
Your use of the Service is subject to our Acceptable Use Policy. You agree not to use the Service to generate content that is hateful, threatening, harassing, defamatory, or that impersonates another person. We reserve the right to suspend or terminate accounts that violate the Acceptable Use Policy.
We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service downtime.
To the maximum extent permitted by law, SongPrompterAI and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that generated lyrics will be free from errors, suitable for any particular purpose, or free from resemblance to existing copyrighted works.
We process personal data in accordance with our Privacy Policy. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
We may suspend or terminate your account if you breach these Terms or the Acceptable Use Policy. You may close your account at any time by contacting [email protected].
Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
